Generalized anxiety can be a disabling condition that keeps a worker from performing their job. When that happens, an INSS insured person is entitled to the temporary disability benefit, provided the legal requirements are met. This article explains how that right works and what to do to obtain it.
What Is Generalized Anxiety Disorder (GAD)?
Generalized Anxiety Disorder, classified under ICD code F41.1 (in Brazil, CID F41.1), is a mental health condition marked by excessive, persistent worry about a wide range of everyday situations. Symptoms include muscle tension, irritability, difficulty concentrating, insomnia, and constant fatigue.
Unlike ordinary anxiety, which everyone experiences from time to time, GAD significantly affects a person’s quality of life and ability to function. In more severe cases, the disorder can make it impossible to perform work activities, which justifies time off work and the granting of a social security benefit.
Requirements for the Temporary Disability Benefit
For an insured person with generalized anxiety to be entitled to the temporary disability benefit (formerly known as auxílio-doença, or sickness benefit), three basic requirements must be met:
Insured status: the worker must be affiliated with INSS, whether as an employee, self-employed contributor, voluntary contributor, or special insured person. Even someone who has lost their job can keep insured status during the grace period, which ranges from 12 to 36 months depending on the situation.
Minimum contribution period of 12 contributions: you must have made at least 12 monthly contributions to INSS before the disability began. Insured persons are advised to keep their contributions up to date to satisfy this requirement.
Generalized anxiety disorder is a condition recognized by the World Health Organization, and it can give rise to a social security benefit when work disability is proven.
Disability proven by a medical examination: the condition must be certified by the INSS medical examiner, who will assess whether the anxiety disorder actually prevents you from performing your occupation.
How the INSS Medical Examination Works
The medical examination is the most important stage in the process of obtaining the benefit. The INSS examiner will review the medical documentation you submit and conduct a clinical exam to determine whether you are unable to work.
You should bring to the examination every document that proves your diagnosis and treatment: detailed medical and psychiatric reports, prescriptions, psychological follow-up reports, supplementary test results, and medical certificates stating how long you need to be off work.
The reports should include the condition’s CID code (F41.1 for GAD), a description of the symptoms, the impact on your ability to work, and the treatment prognosis. The more detailed the documentation, the better your chances of approval.
If the claim is denied after the examination, the insured person may file an administrative appeal with the CRPS (Brazil’s Social Security Appeals Council) within 30 days, or turn to the courts.
Benefit Amount and Duration
The temporary disability benefit equals 91% of the salário de benefício (the benefit base amount), calculated from the average of all contribution salaries since July 1994. How long the benefit lasts depends on the medical assessment; it is paid for as long as the disability persists.
As the end date approaches, the insured person can request an extension of the benefit if still unable to return to work. The extension can be requested through the Meu INSS app or by calling Central 135.
Can Generalized Anxiety Lead to Disability Retirement?
When generalized anxiety disorder proves to be permanent and total, with no prospect of recovery for any kind of work, the insured person may be entitled to permanent disability retirement (formerly called aposentadoria por invalidez).
This conversion happens when, after a period of treatment, the medical examination finds that the disability is permanent. CID F41.1 is recognized as a cause of disability, both temporary and permanent, depending on the severity of the case.
Practical Tips for Filing Your Claim
Here are the main points that improve your chances of having the benefit approved:
Keep up regular, documented psychiatric care. Continuing treatment shows how serious the condition is and makes it easier to prove to INSS.
Ask your treating physician for a detailed report that expressly states your work disability, the medications you take and their side effects, and the estimated length of time off work.
Put all your medical documents in chronological order before the examination. Reports, prescriptions, test results, and records should be legible and well organized.
For guidance on specific cases, an individual review of your situation is recommended to protect your social security rights.
Frequently Asked Questions
Does generalized anxiety entitle you to an INSS benefit?
Yes. Generalized Anxiety Disorder (CID F41.1) can entitle you to the temporary disability benefit or even to permanent disability retirement, provided the INSS medical examination confirms that the condition prevents you from performing your occupation and you meet the requirements of insured status and the minimum contribution period of 12 contributions.
What documents should you bring to the INSS medical examination for anxiety?
You should bring detailed psychiatric reports showing CID F41.1, psychological follow-up reports, prescriptions for controlled medications, supplementary test results, medical certificates stating the time off work, and any document that proves the severity of your symptoms and their impact on your ability to work.
What should you do if the INSS medical examiner denies the anxiety benefit?
The insured person may file an administrative appeal with the CRPS within 30 days of learning of the decision. If the administrative appeal is also denied, it is possible to file a lawsuit, submitting private medical reports and requesting an independent court-appointed medical examination to prove the disability.
