The mandado de segurança is a constitutional tool for defending individual and collective rights against the Government. Its use is limited, it requires a “clear and certain right” that can be proven from the outset, and it follows a fast-track procedure that allows for immediate emergency relief. Not knowing the admissibility requirements is the leading reason these cases are dismissed early.

Constitutional Basis and Legal Nature

The mandado de segurança (a writ of mandamus-type remedy against unlawful acts of public authorities) is grounded in Article 5, items LXIX and LXX, of the Federal Constitution, which establishes it as a fundamental guarantee of citizens against the State. Law 12.016/2009 regulates the remedy at the statutory level, governing the procedure, who may file and against whom, and when both the individual and the collective forms are available.

It is a civil action with a special procedure. Jurisdiction depends on the official who committed the challenged act (the “coercive authority”), not on where the parties live. The subject of the petition is always an act or omission by a public official, carried out in the exercise of government powers, that violates or threatens the petitioner’s individual right in a present or imminent way.

Legal scholars classify the mandado de segurança as a mandamental action. The judgment granting relief does more than recognize the right: it directly orders the official to perform, or refrain from performing, a specific act. This binding character sets it apart from ordinary actions for damages or payment, in which the right is satisfied only through a later enforcement phase.

Requirements for Filing and the Concept of a Clear and Certain Right

To file a mandado de segurança, three requirements must be met at the same time: the existence of a clear and certain right (direito líquido e certo), an unlawful act or abuse of power by a public authority, and the absence of an administrative appeal with suspensive effect or of a specific judicial remedy provided by law. If any one of these elements is missing, the case is dismissed without a ruling on the merits.

The phrase “clear and certain right” does not mean the right must be beyond legal dispute. It means the facts supporting it can be proven from the start, through documents attached to the initial petition, without the need to gather further evidence. When resolving the claim would require expert examination or witness testimony, the mandado de segurança is not the right vehicle.

As for the respondent, Article 1 of Law 12.016/2009 broadened the concept of coercive authority to include agents of private legal entities who are exercising public powers. The deadline for filing is 120 days from the date the petitioner clearly learned of the challenged act. It is a forfeiture period, and no ground for suspending or interrupting it applies.

Procedure and Emergency Relief

Once the initial petition is filed, the judge or reporting judge may grant an injunction inaudita altera pars (without first hearing the other side) whenever there are relevant grounds and a risk that the final remedy would be ineffective. The injunction suspends the effects of the challenged act or orders the omitted act to be performed, depending on what the petition seeks. It remains in force until the ruling on the merits or until the competent court overturns it.

An injunction in a mandado de segurança is not a mere advance ruling: it is a stand-alone tool that immediately halts the unlawful act, preserving the usefulness of the final judicial decision.

After the official is notified to provide information within ten days, the legal representative of the public-law entity is summoned to take part in the case. The Public Prosecutor’s Office must intervene as custos legis (guardian of the law) before the ruling on the merits. Under Article 12 of the governing statute, the judge has thirty days to issue the judgment after the case file returns with the prosecutor’s opinion.

A judgment granting relief takes effect immediately against the official, without any formal enforcement proceeding, because of the mandamental nature of the decision. An appeal against a judgment granting the writ does not automatically suspend it, which preserves the immediate effect of the ruling in the petitioner’s favor, under Article 14 of Law 12.016/2009.

Frequently Asked Questions

Can you file a mandado de segurança against a court decision?

Yes, when the law provides no appeal with suspensive effect against the challenged decision, or when the judicial act is patently absurd (teratológico). Both the Superior Court of Justice (STJ) and the Federal Supreme Court (STF) accept such petitions in these situations, as long as no adequate appeal is available and the decision amounts to illegality or abuse of power in the exercise of judicial functions.

What is the difference between an individual and a collective mandado de segurança?

An individual mandado de segurança is filed by a person or a company to defend its own right. A collective one is reserved for political parties with representation in the National Congress, labor unions, professional associations, or lawfully established associations, acting to defend the interests of their members. In the collective form, the parties entitled to file are those listed in item LXX of Article 5 of the Federal Constitution, and a judgment granting relief benefits everyone represented, without requiring individual consent from each of them.

What happens if the 120-day deadline is missed?

The right to file a mandado de segurança against that specific act is lost. Because the deadline is a forfeiture period, it cannot be suspended or interrupted for any reason. Even so, you are not necessarily left without a remedy: you can seek recognition of the underlying right through ordinary court procedures, such as an action to annul the act or a standard action under the common procedure, as long as the underlying claim has not been barred by the statute of limitations.
