In Brazilian civil procedure, each type of court decision has its own appeal. Knowing the difference between an appeal on the merits (apelação), an interlocutory appeal (agravo), and a motion for clarification (embargos de declaração) is what separates an effective challenge from an appeal rejected for being the wrong vehicle.
The appeals system and the logic of admissibility
The 2015 Code of Civil Procedure organized appeals according to the nature of the ruling being challenged. The rule is simple in principle but decisive in practice: the choice of appeal depends on the type of decision, not on the party’s preference. An appeal filed outside the cases provided by law will tend not to be heard, and the harm is usually irreversible, since the deadline for the correct appeal has often already run out.
For that reason, the first question when facing any unfavorable decision is a technical and objective one: is it a final judgment, an interlocutory decision, or a ruling that simply needs to be clarified or completed? The answer determines the proper instrument and the applicable deadline.
Legal scholarship and case law stress that a mistake in choosing the appeal is rarely excused, except where there is objective doubt about which appeal is available. That is why it is so important to understand the function of each appeal before filing anything.
Apelação: the appeal against a final judgment
The apelação is the appeal directed against a final judgment (sentença), that is, the act by which the judge ends the cognizance phase or the enforcement proceeding at the trial court level. It is governed by Article 1.009 of the Code of Civil Procedure and must be filed within fifteen business days.
As a rule, an apelação has suspensive effect, which prevents the judgment from taking effect immediately until the appellate court rules, under Article 1.012. There are significant exceptions, such as judgments that confirm a provisional remedy or order the payment of support, in which cases enforcement may begin right away.
The appeal transfers to the appellate court the review of the matter challenged, allowing it to revisit both questions of fact and questions of law. It is the primary route for reopening the merits of a case at the second level.
The choice of appeal depends on the type of decision, not on the party’s preference.
It is worth noting that the current system has concentrated in the apelação the challenge to a large share of the issues decided during the proceeding. Interlocutory decisions that cannot be appealed by agravo de instrumento are not immediately barred and may be raised as a preliminary issue in the apelação or in the response brief.

Agravo and embargos de declaração: the other avenues
The agravo de instrumento, provided for in Article 1.015, challenges interlocutory decisions, that is, rulings that resolve issues during the course of a case without ending it. Unlike the apelação, it is available only in the situations listed in the law, such as decisions on provisional remedies, partial judgment on the merits, and jurisdiction. In a repetitive-appeals ruling, the Superior Tribunal de Justiça (Brazil’s Superior Court of Justice) recognized that this list is subject to “mitigated exclusivity,” allowing the agravo where there is urgency because waiting to challenge the decision in a later apelação would be pointless.
There is also the agravo interno (internal appeal), governed by Article 1.021, which is directed against decisions issued by a single appellate judge (the relator) acting alone. Its purpose is to bring the matter before the full panel, ensuring that one judge’s view is reviewed collectively.
The embargos de declaração, for their part, serve a different purpose from the other appeals. Governed by Article 1.022, they are used to cure an omission, contradiction, obscurity, or clerical error in a decision, without directly seeking to overturn it. The deadline is five business days, and filing them interrupts the deadline for other appeals, which makes them a strategic tool for prequestionamento (raising and preserving an issue for review) before appeals to the higher courts.
The proper coordination of these instruments is the backbone of appellate practice. The apelação, agravo, and embargos do not compete with one another: they perform complementary functions within a single system, and mastering the boundaries between them is a condition for an effective defense in court.
Frequently Asked Questions
Which appeal is available against a judgment on the merits?
Against a final judgment, which is the act that ends the cognizance phase or the enforcement proceeding at the trial court level, an apelação is available under Article 1.009 of the Code of Civil Procedure. The deadline is fifteen business days, and the appeal transfers to the appellate court the review of the questions of fact and law being challenged.
When can an agravo de instrumento be used?
An agravo de instrumento is available against the interlocutory decisions listed in Article 1.015, such as those on provisional remedies and jurisdiction. The Superior Tribunal de Justiça established the thesis of mitigated exclusivity, allowing the appeal also where urgency makes it pointless to examine the matter only in a future apelação.
Why are embargos de declaração considered strategic?
The embargos de declaração are used to correct an omission, contradiction, obscurity, or clerical error, under Article 1.022, and have a deadline of five business days. Because they interrupt the deadline for the other appeals and allow issues to be preserved through prequestionamento, they become an important step before filing appeals with the higher courts.
