DPVAT insurance (Personal Injuries Caused by Land Motor Vehicles) is the mandatory insurance that compensates victims of traffic accidents in Brazil for death, permanent disability, and hospital and medical expenses.
What DPVAT Insurance Is and How It Works
DPVAT insurance was established by Law 6.194/1974. It works as a mandatory social insurance that covers personal injuries caused by land motor vehicles, regardless of fault. Every traffic accident victim is entitled to compensation, whether a driver, passenger, pedestrian, or cyclist.
DPVAT compensation does not depend on determining who was at fault in the accident. It is enough that the personal injury (death, disability, or medical expenses) was caused by a land motor vehicle. You do not need to identify the vehicle responsible or prove that the driver acted negligently.
The insurance is paid annually along with vehicle licensing (IPVA, Brazil’s annual vehicle ownership tax). The funds collected are managed by a consortium of insurers under the supervision of SUSEP (Brazil’s Superintendency of Private Insurance). Currently, Caixa Econômica Federal plays a significant role in processing the payments.
Coverage and Compensation Amounts
DPVAT provides three types of coverage, with maximum amounts set by law (Art. 3 of Law 6.194/1974, as amended by Law 11.482/2007): death (R$ 13.500), permanent disability (up to R$ 13.500, depending on the degree of disability), and reimbursement of medical and supplementary care expenses (up to R$ 2.700).
In the case of death, the compensation is paid to the legal beneficiaries (spouse or partner, children, and parents), following the order of intestate succession. If there are no dependents registered with the Previdência Social (Brazil’s social security system), the succession rules of the Civil Code apply.
For permanent disability, the amount of compensation varies with the degree and extent of the injury, according to a specific table that classifies lasting impairments by percentage of disability. Total disability corresponds to R$ 13.500, while partial disability receives a proportional percentage of that amount.
Every traffic accident victim is entitled to compensation, whether a driver, passenger, pedestrian, or cyclist.
Reimbursement of medical expenses covers costs of hospital care, surgeries, medication, physical therapy, and rehabilitation resulting from the accident. The beneficiary must submit proof of payment for expenses incurred at accredited facilities.
How to Claim Compensation
The victim or the victim’s beneficiaries can file the claim directly, with no need for a lawyer or a lawsuit. The claim is submitted to any insurer that belongs to the DPVAT consortium or to Caixa Econômica Federal, depending on the agreement currently in force.
The required documents vary according to the type of coverage. For death: death certificate, police report, IML report (the medical examiner’s report), the beneficiary’s ID, and proof of kinship. For disability: police report, a medical report certifying the permanent disability, and ID. For medical expenses: invoices or receipts for the costs and the police report.
The insurer has 30 days to make the payment after receiving all the necessary documents. If the documentation is incomplete, the insurer must notify the claimant to supply what is missing, and the 30-day period starts over once the missing documents are delivered.
If the insurer wrongfully denies or delays payment, the beneficiary can turn to the courts to collect the compensation, plus interest and inflation adjustment from the date of the accident. In the special courts (small claims courts), the procedure is fast and free of charge at the trial-court level.
Limitation Period and Prescription
The limitation period for claiming DPVAT compensation is 3 years, under Art. 206, § 3, IX, of the Civil Code. The period starts to run on the date of the accident (for disability and medical expenses) or on the date of death (for death compensation).
When a disability develops gradually, the case law of the STJ (Brazil’s Superior Court of Justice) allows the limitation period to start on the date the victim becomes unmistakably aware of the extent of the disability, usually when the final medical report is issued.
For minors who are accident victims, the statute of limitations does not run during minority (Art. 198, I, of the CC, the Civil Code). The 3-year period starts only when the minor turns 16 (partially incapacitated) or 18 (fully capable), depending on the situation.
Recent Changes and the Current Status of DPVAT
DPVAT has gone through several legislative reforms over the years. Law 11.482/2007 significantly changed the amounts and procedures. The federal government went so far as to abolish the insurance in 2020, but the abolition was reversed by the courts, and the insurance remains in force.
The management of DPVAT has been the subject of controversy, including allegations of fraud, mismanagement of funds, and payment delays. SUSEP and oversight bodies monitor how the funds are used, which must go exclusively to paying compensation and maintaining the system.
Traffic accident victims should stay alert to their rights, because many are unaware that DPVAT exists or believe they are entitled to compensation only if the vehicle that caused the accident is identified. The insurance covers accidents involving unidentified vehicles (hit-and-run accidents) and accidents involving uninsured vehicles.
Frequently Asked Questions
Who is entitled to DPVAT compensation?
Every victim of an accident involving a land motor vehicle is entitled to DPVAT compensation, regardless of fault. That includes drivers, passengers, pedestrians, cyclists, and anyone who suffers personal injury as a result of the accident. You do not need to identify the vehicle responsible or prove that the driver acted negligently.
Can I receive DPVAT even without a police report?
The police report is one of the documents required for the claim, but not having one does not prevent payment of the compensation. The victim can prove the accident by other means, such as hospital reports, records from SAMU (Brazil’s mobile emergency medical service), a hospital admission statement, and witnesses. The insurer cannot deny payment solely because of the lack of a police report if there is other proof of the accident.
What is the deadline for claiming DPVAT compensation after the accident?
The limitation period is 3 years from the date of the accident (for disability and medical expenses) or from the date of death (for death compensation). After that period, the right to compensation expires. For minors, the statute of limitations starts to run only when they turn 16 or 18, depending on the case. It is advisable to file the claim as soon as possible.
