Permanent disability retirement gives INSS (Brazil’s National Social Security Institute) insureds rights that go beyond the monthly benefit, including income tax exemption, payoff of a home mortgage, and a 25% increase in the benefit amount.

What Permanent Disability Retirement Is

Permanent disability retirement, formerly known as disability retirement (aposentadoria por invalidez), is provided for in Article 42 of Law No. 8.213/91. Constitutional Amendment No. 103/2019 (the Social Security Reform) changed the name of the benefit, but its essential requirements remain the same.

To qualify, you must meet three requirements: maintain your insured status with the INSS, have completed the waiting period of 12 monthly contributions, and prove total and permanent incapacity for work through a medical examination. The waiting period is waived in cases of accidents of any kind, occupational disease, or a serious illness listed in Article 151 of Law No. 8.213/91.

The benefit depends on a medical examination conducted by the INSS, which must certify that the incapacity is permanent and prevents you from performing any work activity. If you already receive the temporary disability benefit (formerly auxílio-doença) and the examination concludes that rehabilitation is not possible, the benefit can be converted into permanent disability retirement.

25% Increase for Total Dependence on Others (Grande Invalidez)

Article 45 of Law No. 8.213/91 provides for a 25% increase in the amount of permanent disability retirement for insureds who need permanent assistance from another person. This supplement, known as “grande invalidez,” can be requested at any time after the benefit is granted. There is no statute-of-limitations deadline for the request.

Annex I of Decree No. 3.048/99 lists the situations that qualify for the supplement, such as total blindness, paralysis of the upper or lower limbs, loss of limbs, and changes in mental faculties with serious disturbance of organic and social life. The case law of the Superior Court of Justice (STJ) has established that this list is illustrative (not exhaustive). In other words, other conditions that demonstrably require permanent assistance can also give rise to the increase.

The benefit depends on a medical examination conducted by the INSS, which must certify that the incapacity is permanent and prevents you from performing any work activity.

It is important to note that the 25% supplement is not carried over to the death pension owed to the dependents of the deceased insured, under Article 45, sole paragraph, item c, of Law 8.213/91. The supplement therefore ends with the retiree’s death. In judging Theme 1095, the Federal Supreme Court (STF) held that only a statute can create or expand a social security benefit, which confines the increase to permanent disability retirement.

Income Tax Exemption

Article 6, item XIV, of Law No. 7.713/88 exempts from income tax the retirement income received by people with serious illnesses. The list includes: irreversible and disabling paralysis, serious heart disease, malignant neoplasm (cancer), blindness (including blindness in one eye), Hansen’s disease (leprosy), Parkinson’s disease, ankylosing spondylitis, severe nephropathy, severe liver disease, advanced stages of Paget’s disease, radiation contamination, AIDS, multiple sclerosis, and cystic fibrosis.

STJ Summary Precedent 627 established that the exemption does not require proof of current symptoms of the disease. A medical report showing that you contracted the illness is enough. This means that even a retiree whose cancer is in remission, for example, keeps the right to the exemption.

If you paid income tax improperly, you can request a refund of the amounts withheld over the past five years. The procedure involves obtaining an official medical report, filing a request with the paying source (the INSS), and, if necessary, bringing a lawsuit to secure the right.

Payoff of a Home Mortgage

Home financing contracts entered into under the Housing Finance System (SFH) include mandatory housing insurance, as required by Decree-Law No. 73/66. This insurance covers the borrower’s permanent disability and allows the full payoff of the outstanding mortgage balance.

To trigger the coverage, a retiree with permanent disability must submit a medical report to the insurer linked to the contract, usually through the lender. It is essential to check whether the contract contains a preexisting-condition exclusion clause, because the insurer may deny coverage if the incapacity results from a condition that existed before the insurance was taken out.

Full Withdrawal of Your FGTS (Length-of-Service Guarantee Fund)

Article 20, item XIV, of Law No. 8.036/90 authorizes the full withdrawal of the Length-of-Service Guarantee Fund when the worker (or a dependent) is affected by a serious illness that results in permanent disability retirement. The withdrawal covers the entire available balance, including active and inactive accounts from previous jobs.

In addition to the FGTS, a retiree with permanent disability can withdraw shares of the PIS/PASEP fund (Brazil’s worker and public servant savings program), under Complementary Law No. 26/75, as long as the retiree proves permanent disability to the depositary bank. This right is separate from the annual PIS salary bonus, which has its own rules.

Exemptions on Vehicle Purchases

Law No. 8.989/95 (Article 1, item IV) grants an exemption from IPI (the federal excise tax on manufactured goods) on the purchase of new vehicles by people with physical, visual, or severe or profound mental disabilities, as well as people with autism. A retiree with permanent disability who qualifies as a person with a disability can take advantage of this benefit, which can currently be renewed every three years.

In addition, ICMS Agreement No. 38/2012 authorizes an exemption from ICMS (the state tax on the circulation of goods and services) on vehicle purchases by people with disabilities. This exemption varies according to each state’s legislation, so you need to check the local rules in force. In Minas Gerais, for example, Law No. 14.937/2003 governs the matter.

The exemption from IPVA (the state vehicle ownership tax) also depends on state legislation, and each state sets its own requirements for granting the benefit. In every case, you need a medical report certifying the applicant’s disability.

Transportation, Priority Handling of Cases, and Health Plans

Law No. 8.899/94, regulated by Decree No. 3.691/2000, establishes the federal Free Pass (Passe Livre), which provides free interstate public transportation for people with disabilities who can show financial need (per capita family income of up to one minimum wage). A retiree with permanent disability who meets the requirements can apply for the benefit with the Ministry of Transport.

As for how quickly cases move through the system, Article 1.048, item I, of the Code of Civil Procedure guarantees priority handling for people with a serious illness, regardless of age. This applies to both court and administrative proceedings, including requests filed with the INSS and social security lawsuits.

A retiree who had an employer-sponsored health plan has the right to keep it after retirement, under Articles 30 and 31 of Law No. 9.656/98. Keeping the plan requires paying the full monthly premium (the employee’s share and the employer’s share), and the length of time you can stay in the plan is proportional to how long you contributed to it.

Protection Against Improper Termination, and Death Pension

Article 43, §§ 4 and 5, of Law No. 8.213/91, as amended by Law No. 13.847/2019, establishes important protections for retirees. An insured who is over 60 years old, or over 55 and has received the benefit for at least 15 years, is exempt from periodic medical reevaluation. In all other cases, the benefit can be terminated only after a new medical examination proves that the ability to work has been recovered.

If a retiree with permanent disability dies, the dependents are entitled to a death pension under Article 74 and following of Law No. 8.213/91. The duration and amount of the pension follow the general rules for the benefit and vary according to the dependent’s age and circumstances. In complex situations involving multiple benefits, it is advisable to seek specialized guidance on social security planning.

Frequently Asked Questions

Can you work while receiving permanent disability retirement?

As a rule, paid work is incompatible with permanent disability retirement, because the benefit presupposes total incapacity for work. If the INSS finds that a retiree is working, it can call for a new medical examination and may end the benefit. There are legal debates about low-complexity or therapeutic activities, but the safe course is to seek professional advice before starting any activity.

How do you apply for the 25% supplement for total dependence on others?

You must request the supplement from the INSS by scheduling a specific medical examination. It is not granted automatically with the retirement. The examiner will assess whether you need permanent assistance from another person for daily activities. You can make the request at any time after permanent disability retirement is granted, with no deadline.

Can you combine permanent disability retirement with another INSS benefit?

Social security law prohibits combining permanent disability retirement with other retirement benefits or with the temporary disability benefit. You can, however, combine it with a death pension, subject to the accumulation rules introduced by Constitutional Amendment No. 103/2019. Those rules provide for receiving the full amount of the higher benefit plus a percentage of the other, according to brackets set by law.
