Ruling by a Judge Reassigned After a Court Swap Is Valid
The Third Panel of the Superior Court of Justice held, by majority vote, that a ruling issued by a judge who had already been transferred out of her original court through a swap of posts is valid. The panel gave weight to cooperation by agreement, provided for in the Code of Civil Procedure, and to the principles of orality and immediacy. The decision has significant practical impact on the stability of rulings issued when judges are transferred, on leave, or temporarily replaced.
