Proving old periods of contribution to INSS (Brazil’s National Social Security Institute) is essential to securing your right to retirement with the correct amount of contribution time. Many insured workers run into trouble because records were lost, companies closed, or the data simply does not appear in the INSS system. In this article, we explain which documents you can use and how to recover those periods.
Why Old Periods May Not Appear in the CNIS
The National Social Information Registry (CNIS) is the main database INSS uses to verify an insured worker’s contribution time. However, contributions made before 1976, when the record-keeping system was still rudimentary, often do not appear in this registry. In addition, companies that shut down may not have properly passed their information on to the government.
Even after 1976, the CNIS data sometimes contains inconsistencies. Typos in your name, in your PIS/PASEP (Brazil’s employee social integration program) number, or in hiring and termination dates are recurring problems. In these cases, you need to gather documentary evidence and ask INSS to correct the record.
Another important factor is rural work performed under a family-farming arrangement. Until the 1988 Constitution, most of these workers had no formal record, which makes proof even more challenging. Below, we review the main accepted means of proof.
Documents Accepted to Prove Contribution Time
Brazilian social security legislation recognizes a variety of documents as initial documentary evidence of work periods. Among the most important are:
- The Work and Social Security Card (CTPS), even with old or partly illegible entries
- Contribution payment booklets (GPS, the Social Security payment slip) for self-employed or voluntary contributors
- Certificates of length of service issued by employers or public agencies
- Statements from former employers with notarized signatures
- Paychecks, payment receipts, and pay stubs
- Employee registration records obtained from boards of trade (juntas comerciais) or labor unions
- Documents in the name of third parties (a spouse or parents) that indicate the work performed, especially for rural work
- Marriage certificates, children’s birth certificates, or voter registration cards that list your occupation
Even with erasures or old entries, a work card carries a rebuttable presumption of accuracy and is considered one of the most important documents for proving employment relationships before INSS.
Note that the case law of the Federal Regional Courts has broadened the list of documents accepted as initial documentary evidence, even allowing school records, enrollment forms, and union documents.
How to Request an Update to Your CNIS
If you notice that certain periods are missing from your CNIS statement, the first step is to gather all the documentation you have. Then we recommend scheduling an appointment with INSS through the Meu INSS portal or by calling 135 to request that the data be added or corrected.
Your administrative request should include certified or scanned copies of the supporting documents. INSS has a legal deadline of 30 days to review the request, and it may ask for additional documentation if needed.
If the company has closed, you can seek information from the Board of Trade (Junta Comercial) of the state where the company was registered, from the union for your profession, or even from the Ministry of Labor and Employment. These agencies may hold records that help prove the employment relationship.
The Role of Witness Testimony
Witness testimony alone, without any accompanying document, is not enough to prove contribution time, according to Precedent (Súmula) 149 of the Superior Tribunal de Justiça (Brazil’s Superior Court of Justice). However, when it is backed by initial documentary evidence, witness statements become extremely important.
For rural workers, the law allows initial documentary evidence to be supplemented by testimony from neighbors, coworkers, or community members. This combination is frequently used in social security lawsuits and has been widely accepted by the courts.
We advise choosing witnesses who actually lived or worked alongside you during the period you want to prove and who can describe in detail the work you did, where you worked, and the conditions under which the work was performed.
When to Go to Court
If INSS denies your administrative request, you can file a lawsuit. In court, there are more ways to present evidence, including hearings to question witnesses and requests for documents from public agencies and companies.
The Federal Courts have jurisdiction over social security cases. Claims worth less than 60 minimum wages can be filed in the Federal Special Courts (Juizados Especiais Federais), and you do not need a lawyer for claims of up to 20 minimum wages. Even so, we strongly recommend the help of a lawyer who specializes in social security law to ensure the case is properly built.
Keep in mind that the limitation period to request a review of a benefit is 10 years, counted from the first day of the month following the receipt of the first payment. The right to the benefit itself, however, does not expire. In other words, you can apply for retirement at any time, as long as you can prove you meet the requirements.
Practical Tips for Preserving Your Documents
We recommend that every worker keep organized copies of their social security and employment documents. Scanning your work card, contribution booklets, and pay stubs is a simple step that can prevent major problems down the road.
Checking your CNIS statement regularly through the Meu INSS portal is also essential. The sooner you spot an inconsistency, the easier it is to fix, because the supporting documents will be easier to obtain and witnesses will have a clearer memory of the facts.
If you are self-employed or a individual contributor, keeping every proof of payment for your GPS slips is indispensable, because these documents are the main evidence that your contributions were actually paid.

Frequently Asked Questions
Can I use my work card even if the entries are crossed out?
Yes. The CTPS carries a presumption of accuracy, even with erasures or partly illegible entries. INSS and the courts treat the entries as valid unless there is clear proof of fraud. We recommend submitting other supporting documents to strengthen your proof.
How long does INSS take to correct CNIS data?
The legal deadline to review a correction request is 30 days, but in practice it can take longer, especially when additional inquiries are needed. If INSS does not respond within a reasonable time, you can file a writ of mandamus (mandado de segurança) to compel a decision.
Can unregistered rural work count as contribution time?
Yes. Rural work under a family-farming arrangement can be recognized as contribution time if it is proven by initial documentary evidence supplemented by witness testimony. Documents such as a marriage certificate listing your occupation as farmer, invoices for the sale of your produce, and statements from a rural union are widely accepted.
