The accident benefit (auxílio-acidente) is a Brazilian social security benefit that compensates workers when a permanent sequela, even a partial one, reduces their ability to do the work they habitually performed. Unlike benefits that replace your salary while you are off the job, it is paid alongside your earnings and works as financial compensation for the loss of full working capacity.
What the accident benefit is and what it is for
The accident benefit is established in Article 86 of Law 8.213/91 and equals 50% of the insured worker’s benefit calculation base (salário de benefício). It is owed when, after injuries from an accident of any kind have stabilized, lasting sequelae (permanent after-effects) leave the person with a lasting reduction in the capacity to do the work they were performing at the time of the accident.
What defines this benefit is its compensatory nature. It does not require total incapacity for all activity, and you do not have to stop working. You only need to show that the sequela impairs, even partially, your usual professional performance, so that the same tasks now take more effort.
The difference between compensating and replacing income
The most common confusion on this subject is treating the accident benefit as if it were a disability benefit. They are different programs with opposite purposes. The temporary disability benefit, formerly known as auxílio-doença (sickness benefit), replaces income while the insured worker is unable to work. It ends when the worker recovers or retires for disability.
Permanent disability retirement, in turn, permanently replaces your salary when you can no longer perform any activity that would support you. In both cases, the underlying premise is an inability, total or partial, to keep earning a living.
The accident benefit starts from a different premise. It is paid precisely because the insured worker remains able to work, even if with limitations. The benefit does not fill a gap in income. It compensates for the extra effort the sequela now demands of the worker in daily professional life.
The accident benefit does not make up for a missing paycheck: it compensates for the lost full capacity of someone who keeps working.
This distinction has important practical effects. Because the benefit is compensatory, it is not subject to the current minimum wage floor and may be set at a lower amount. The logic is consistent: the goal is not to guarantee a minimum subsistence income, but to quantify the reduction in working capacity as a proportion of the benefit calculation base.
The accident benefit is established in Article 86 of Law 8.213/91 and equals 50% of the insured worker’s benefit calculation base.
Who is entitled to the accident benefit
Three basic requirements must all be met. The first is insured status on the date of the accident. The second is a causal link between the event and the injury. The third, and the most decisive, is a permanent sequela that reduces the capacity to perform the work you habitually did, determined after the clinical condition has stabilized.
Not every insured person is covered, however. The benefit is available to employees, including domestic workers, to casual (avulso) workers, and to those in the special insured category (segurado especial). Domestic workers gained this coverage through the legislation that regulated their occupation and extended this specific protection to them.
Self-employed contributors (contribuinte individual) and voluntary insured persons (segurado facultativo) are left out. For these categories, Brazilian law does not provide for the accident benefit, even if the person suffers an accident that leaves sequelae. This is an important restriction, and it should be checked at the very start of any claim.
How the benefit can be combined with your salary
The point that raises the most questions is whether you can receive the accident benefit together with your salary. The answer is yes: precisely because it is compensatory, the benefit is paid monthly while the worker stays on the job, added to their usual earnings.
This combination has limits, however. The accident benefit cannot be received together with a retirement pension. Under the legislation that amended Law 8.213/91 in the late 1990s, the benefit ends when the insured worker retires, and its amount is incorporated into the calculation of the retirement income, since it forms part of the contribution salary base (salário de contribuição).
Receiving more than one accident benefit at the same time is also not allowed. If a new accident causes new sequelae, the condition is reassessed, and two benefits of the same kind are not added together. In addition, the benefit does not pass to dependents. It ends with the death of the insured worker and does not generate a separate survivor’s pension.
In practice, the best strategy is to document the sequela and its impact on your work routine with care. The medical expert report is the central piece of evidence, and a precise description of your functional limitations often makes the difference between having your right recognized or denied, whether in the administrative process or in court.
How to apply for the accident benefit
As a rule, the claim begins in the administrative process, with an application to the INSS (Brazil’s National Social Security Institute) and the scheduling of a medical examination. At this stage, the insured worker should gather all the documents that prove the accident, the course of treatment and the stabilization of the injuries, because it is the stabilization of the clinical condition that gives rise to the right to the benefit. Medical reports, imaging tests and medical certificates help show that the sequela is permanent.
When the benefit is denied in the administrative process, you may appeal or take the matter to court. In court, technical evidence becomes even more important, since the judge usually orders a medical expert examination to determine whether the injury actually reduces working capacity. The clarity of the questions put to the expert and the quality of the attached documents directly affect the outcome.
The start date of the benefit is often disputed. As a general rule, the starting point is the day after the end of the disability benefit that preceded the claim, or the date of the administrative application, depending on the circumstances. Setting this date correctly affects the amount of any back payments owed to the insured worker.
Frequently Asked Questions
Does the accident benefit stop me from continuing to work?
No. The benefit assumes that the insured worker stays on the job, even with limitations caused by the sequela. It is paid alongside your salary and does not require you to leave work, unlike disability benefits, which replace income during the period when you are unable to perform your duties.
How much is the accident benefit?
The benefit equals 50% of the insured worker’s benefit calculation base, which is determined from your contributions. Because it is compensatory, it may be set at an amount below the current minimum wage. Its purpose is not to guarantee a minimum subsistence income, but to compensate for the partial and permanent reduction in working capacity.
Can I receive the accident benefit together with a retirement pension?
No. Receiving the accident benefit together with a retirement pension was prohibited by the legislation that amended Law 8.213/91 in the late 1990s. When the insured worker retires, the accident benefit ends, and its amount becomes part of the calculation of the retirement income, since it is included in the contribution salary base over the period in which it was received.
