The requirement to file the Brazilian individual income tax return applies to taxpayers in a variety of situations. Choosing between the simplified and the complete model, and deducting expenses correctly, determines the final amount of your refund or the tax you owe.

Who Must File the Return

Each year, the Receita Federal (Brazil’s federal tax authority) issues a normative instruction defining the situations in which filing the annual adjustment return is mandatory. If you fall into any of those situations, you must meet this tax obligation on time. Otherwise, you face a late-filing penalty and may be held up in the malha fina (the tax authority’s audit screening).

Filing is mandatory in situations such as these: you received taxable income above the annual limit set by the Receita Federal; you received exempt, non-taxable, or exclusively withheld-at-source income above the established ceiling; you realized a capital gain on the sale of assets or rights that is subject to the tax; or you carried out transactions on stock, commodities, futures, and similar exchanges.

You must also file if you had gross income from farming above the established amount, owned assets or rights whose total value exceeded the set limit on the reference date, became a Brazilian resident during the calendar year, or chose the capital gains tax exemption on the sale of a residential property followed by the purchase of another within the period set by law.

Simplified or Complete: A Strategic Decision

You can choose between two tax models. The simplified model replaces all legal deductions with a standard discount capped by the Receita Federal. In the complete model, you report each deductible expense individually and subtract it from the tax base. The choice is not a mere formality, because it directly affects the result.

The simplified model tends to favor people with few deductible expenses to document, especially taxpayers with average income and a small household. The complete model is usually advantageous if you bear significant expenses for health care, education, dependents, and private pension plans, where the sum of your legitimate deductions exceeds the cap on the standard discount.

A sound strategy involves running both models in the Receita Federal’s own software before you submit. The system automatically shows which option results in less tax owed or a larger refund. Even so, planning ahead is essential to make sure every deductible expense is documented and actually entered.

A escolha entre simplificado e completo não é mera formalidade: define o valor final da restituição.

Taxpayers who file at the last minute often lose deductions because their paperwork is disorganized. Ideally, you keep a physical or digital folder of supporting documents throughout the year: medical receipts, school contracts, proof of court-ordered alimony payments, and statements from a PGBL (a type of private pension plan) account.

If you fall into any of those situations, you must meet this tax obligation on time. Otherwise, you face a late-filing penalty and may be held up in the audit screening.

Deductible Expenses and Legal Limits

Law 9.250/1995 and its amendments establish the list of expenses that can be deducted in the complete return. The main categories are: medical expenses, with no cap on the amount, covering appointments, tests, hospital stays, prostheses, orthopedic devices, and dental treatment, as long as they are documented with the provider’s name, address, and CPF (Brazil’s individual taxpayer ID number) or CNPJ (Brazil’s corporate taxpayer ID number); and education expenses, subject to an annual cap per dependent or for the taxpayer, and limited to early childhood education, elementary, middle and high school, college, and vocational technical education.

Other deductions include: dependents, with a fixed annual deduction for each person who meets the criteria in the law, such as children up to age 21 (or up to 24 if enrolled in college), a spouse or partner, and parents or grandparents whose income did not exceed the limit; alimony, fully deductible when set by a court decision, a court-approved agreement, or a public deed; and contributions to the official pension system and to PGBL supplemental pension plans, the latter limited to a percentage of annual taxable income.

If you are a self-employed professional who keeps a Livro Caixa (a cash book of business income and expenses), you can deduct the expenses necessary to earn your income and maintain your source of revenue. Examples include rent for your office, water, electricity, phone, supplies, and pay for employees with registered employment, subject to the specific rules of that regime.

Documentation and the Risk of the Audit Screening

Improper deductions are the main reason returns are held in the malha fina. The Receita Federal cross-checks information with service providers, health plan operators, schools, and paying entities, and any discrepancy triggers the automated filter. If you deduct an expense without valid documentation, you face disallowance of the deduction, payment of the additional tax with interest and a penalty, and, where fraud is established, possibly a tax referral for criminal prosecution.

You should keep every supporting document for five years, counted from the fiscal year following the filing of the return, because of the statute of limitations on the government’s right to assess the tax debt. Receipts without a CPF or CNPJ, generic proofs of payment, and unsigned contracts do not meet the standard of proof required in an audit, and you should replace them before you submit.

You can monitor the processing statement on the e-CAC portal (the Receita Federal’s online taxpayer service center), which you access with a digital certificate or a gov.br account. This lets you identify problems and answer any notice within the deadline, avoiding an assessment issued by the tax authority on its own initiative and registration as outstanding government debt (dívida ativa). A timely response with organized documentation resolves a good share of initial assessments.

Frequently Asked Questions

What happens in practice if I file after the deadline?

Filing late triggers a minimum penalty set by the Receita Federal, plus a percentage of the tax owed, capped at the maximum amount of the tax assessed. If you are due a refund, the penalty is deducted from the amount you receive. Besides the financial cost, a late filer may have their CPF placed in irregular status. This makes it harder to obtain certificates and financing until the problem is resolved.

How do I decide between the simplified and the complete model?

The decision depends on whether your total deductible expenses exceed the standard discount of the simplified model. Taxpayers with significant spending on health care, education, court-ordered alimony, or PGBL contributions usually get a better result with the complete model. The Receita Federal’s software lets you simulate both scenarios at once and automatically shows the more advantageous one, but an informed choice requires organized documentation throughout the year.

Can I amend my return after submitting it?

Yes. You can file an amended return as long as no tax audit procedure has begun. You can change data, add forgotten expenses, correct income, or switch tax models within the regular period. Once an audit has begun, amendments are limited and may not be accepted. Filing an amended return before the return is flagged in the malha fina is the safest way to correct omissions and avoid the multa de ofício (the penalty the tax authority imposes on its own initiative), which is generally harsher than the penalty for voluntary self-correction.
