Can You Work While Receiving Sickness Benefit or Disability Retirement?

One of the most common questions among the more than 6 million insured people who receive incapacity benefits from the INSS (Brazil’s National Social Security Institute) (Social Security Statistical Bulletin, 2025) is whether they can work while receiving them. The short answer: in most cases, no.
Why are incapacity benefits and work incompatible?
Under Article 46 of Law 8.213/91, performing paid work is incompatible with incapacity benefits. INSS data show that about 35% of sickness benefits are terminated because the beneficiary returned to work (Social Security Statistical Yearbook, 2024).
The logic behind this is straightforward. If a person is able to work, the law presumes that he or she has regained work capacity. The benefit exists precisely for people who are incapacitated, whether temporarily or permanently. Going back to work contradicts that premise.
But is every situation really so black and white? Not always. That is why we will look at each type of benefit separately.
How does it work for sickness benefit?
The sickness benefit (auxílio-doença, or temporary incapacity benefit) is set out in Article 59 of Law 8.213/91. It is granted when an insured person is unable to work because of illness or accident for more than 15 consecutive days.
Returning to work while receiving the benefit is treated as recovery of work capacity. Article 60, § 8, read together with Article 46, provides for the immediate cancellation of the benefit in that situation. The rule leaves no room for tolerance.
What about disability retirement?
The disability retirement (aposentadoria por invalidez, or permanent incapacity retirement) requires total and permanent incapacity for any activity, under Article 42 of Law 8.213/91. The situation here is even more restrictive.
The STJ (Brazil’s Superior Court of Justice) has ruled that returning to work, as a rule, justifies cancellation. Still, each case needs individual analysis. The nature of the activity and the insured person’s limitations influence the court’s decision.

What exceptions allow you to work?
Law 8.213/91 provides for specific exceptions. Article 62 allows participation in a vocational rehabilitation program without cancellation of the benefit, covering about 18 thousand insured people per year (INSS Management Report, 2024).
Vocational rehabilitation program
During rehabilitation, the insured person may engage in activities for therapeutic and retraining purposes. The benefit continues to be paid as usual. Article 62 of Law 8.213/91 guarantees that the benefit is maintained throughout the program.
In practice, few insured people know about this right. Many avoid seeking rehabilitation for fear of losing the benefit, when in fact the law protects exactly this situation.
What happens if you are a MEI?
There is a gray area involving the Individual Microentrepreneur (MEI). Merely registering as a MEI does not automatically mean you have returned to work. The specific case must be analyzed.
INSS data show that about 35% of sickness benefits are terminated because the beneficiary returned to work (Social Security Statistical Yearbook, 2024).
Now, if you are actually performing paid work that is incompatible with your incapacity, the benefit will be canceled. The Federal Regional Courts have held that an active MEI registration shows work capacity. Did you know that the INSS regularly cross-checks MEI data with the Federal Revenue Service?
What are the consequences of working irregularly?
The INSS identifies irregularities in about 180 thousand benefits per year through data cross-checking (INSS Management Report, 2024). The consequences of working while receiving an incapacity benefit are severe.
The penalties include:
- Immediate cancellation of the benefit, retroactive to the date you returned to work
- Repayment of all amounts improperly received, under Article 115 of Law 8.213/91
- Administrative proceedings for social security fraud
- A lawsuit for reimbursement filed by the INSS
- Criminal liability for fraud (estelionato) (Article 171 of the Penal Code), punishable by 1 to 5 years in prison and a fine
The financial risk goes beyond repayment. The INSS may charge interest and inflation adjustment on the amounts, and the debt may be entered in the federal government’s active debt registry (dívida ativa da União), affecting the beneficiary’s CPF (Individual Taxpayer Registry number) for years.
How does the INSS find out that an insured person is working?
The INSS oversight system cross-checks data from more than 10 government databases, including the CNIS (National Social Information Registry), the CAGED (General Registry of Employed and Unemployed Persons), the Federal Revenue Service and invoice records (INSS Transparency Portal, 2025). Detection of irregular work is increasingly automated.

What should you do if your health improves during the benefit?
If you are receiving sickness benefit or disability retirement and feel better, the correct path involves specific steps. Under INSS Normative Instruction 128/2022, the insured person must report any change in his or her health condition.
Follow these guidelines:
- Request a medical examination from the INSS to reassess your work capacity
- Wait for the official medical discharge before returning to any activity
- Notify the INSS of changes in your health condition
- Do not take the risk of working without authorization, even in light activity
A social security lawyer can advise you on the possibility of joining a rehabilitation program, which keeps your benefit in place while you readjust to work.
