Difference Between Disability Retirement and Sickness Benefit 2026: Requirements and Amount. In 2024 alone, the INSS (Brazil’s National Social Security Institute) granted more than 2.5 million disability benefits, according to data from the Statistical Yearbook of Social Security (AEPS/MPS, 2024).

In 2024 alone, the INSS granted more than 2.5 million disability benefits, according to data from the Statistical Yearbook of Social Security (AEPS/MPS, 2024). Even so, most insured workers do not know the difference between the temporary sickness benefit (auxílio-doença) and disability retirement. One is temporary. The other is permanent. And the amount you receive differs considerably.
What is the difference between the sickness benefit and disability retirement?
The central difference is how long the incapacity lasts. Under Article 59 of Law 8.213/91, the sickness benefit covers temporary incapacity: the insured worker is expected to recover. Disability retirement (Article 42), on the other hand, requires total and permanent incapacity, with no chance of rehabilitation.
The sickness benefit works as short-term support. You stay off work, undergo treatment, and go back to your job. The INSS schedules periodic medical examinations to assess your progress.
Disability retirement, renamed by the Social Security Reform (EC 103/2019, Constitutional Amendment 103/2019) as retirement for permanent incapacity, follows a different logic. It assumes that no professional activity is feasible, even with retraining.
But is this distinction really so rigid in practice? Not always. Many insured workers start with the sickness benefit and, over time, convert it into disability retirement when their condition worsens.
What are the requirements for each benefit?
Both benefits share the same waiting period (carência) of 12 monthly contributions, under Law 8.213/91. The waiting period is waived in cases of accidents of any kind or of the serious illnesses listed in Article 151 of the Law, a list that includes cancer, AIDS, and severe heart disease.
Requirements for the sickness benefit
To receive the sickness benefit, the insured worker must meet four conditions at the same time:
- Insured status: being registered with the INSS and up to date on contributions (or within the grace period).
- 12-month waiting period: waived in cases of accident or occupational illness (Art. 26, II).
- Temporary incapacity: proven by an INSS medical examination.
- Leave of more than 15 days: during the first 15 days, the employer pays.
Requirements for disability retirement
Retirement for permanent incapacity requires stricter conditions:

- Insured status: the same requirement as for the sickness benefit.
- 12-month waiting period: also waived for accidents or serious illness (Art. 151).
- Total and permanent incapacity: for any work activity.
- Impossibility of retraining: determined after a vocational rehabilitation assessment by the INSS.
The practical difference between the requirements lies in the extent of the incapacity: the sickness benefit accepts partial incapacity (only for your usual occupation), while disability retirement requires total incapacity (for any work).
How is each benefit calculated?
The Social Security Reform changed how both benefits are calculated. The sickness benefit pays 91% of the average salary, while disability retirement dropped to 60% + 2% for each extra year of contributions, under Art. 26, § 2 of EC 103/2019.
Amount of the sickness benefit
The sickness benefit calculation is straightforward:
- 91% of the average of all contribution salaries since July 1994.
- No application of the pension factor (fator previdenciário).
- Cap limited to the average of the last 12 contributions.
Amount of disability retirement
The calculation for retirement for permanent incapacity became more complex after 2019:
- 60% of the average salary + 2% for each year beyond 20 years of contributions (men) or 15 years (women).
- 100% of the average when the incapacity results from a workplace accident or occupational illness (Art. 26, § 3, EC 103/2019).
- 25% supplement for insured workers who need permanent assistance from another person (Art. 45, Law 8.213/91).
In practice, this change hurt younger insured workers. Men with fewer than 20 years of contributions receive less than 60% of the average. Before the Reform, everyone received 100%. This reduction makes retirement planning even more important for anyone with a chronic illness.
What are the practical differences in the insured worker’s daily life?
About 30% of sickness benefits lasting more than 2 years end up converted into disability retirement, according to a survey by the IBDP (Brazilian Institute of Social Security Law, 2023). This shows that the line between the two benefits is not always clear.
Medical examinations and reviews
The sickness benefit requires periodic review through a medical examination, usually every 6 months. It may be terminated when the insured worker regains the ability to work, or converted into disability retirement.
Disability retirement can also be reviewed during the first 5 years (Art. 101, Law 8.213/91). After that period, a review happens only at the request of the insured worker. In other words, after 5 years, the benefit becomes more stable.
Returning to work
If you receive the sickness benefit, you go back to work immediately after the medical examiner discharges you. No complications.
A person retired for disability who voluntarily returns to work, however, automatically loses the benefit (Art. 46, Law 8.213/91). This rule frightens many insured workers. What if I improve partially? Can I try working? The answer is: any paid activity cancels the retirement.
INSS Normative Instruction 128/2022 provides that vocational rehabilitation must be offered as a priority to long-term sickness benefit recipients.
In courtroom practice, many insured workers on a prolonged sickness benefit never request conversion for fear of losing their current benefit during the process. A social security lawyer can assess whether conversion is feasible without a break in payments.
What should you do if the INSS denies your disability benefit?
According to the CNJ (National Council of Justice, 2024), lawsuits against the INSS make up the largest caseload in the Federal Courts, with more than 4 million active cases. A good share of them involve denials of disability benefits.
The insured worker has 30 days to file an administrative appeal after a denial. The appeal is free and is heard by the INSS Appeals Board. If the denial is upheld, you may file a lawsuit at any time.
The STJ (Superior Court of Justice) has established the understanding that the termination of a sickness benefit does not prevent a new application for disability retirement. If the medical condition has worsened, or if the earlier medical examination was mistaken, the insured worker may apply for the more serious benefit.
Document everything. Specialist reports, recent tests, treatment records: every piece of medical evidence strengthens your claim. The INSS decides based on its own medical examination, but the judge may appoint an independent expert if there is disagreement.

Frequently Asked Questions
Who is entitled to disability retirement or the sickness benefit?
The criterion is the nature of the incapacity, not the insured worker’s choice. Article 59 of Law 8.213/91 grants the temporary incapacity benefit to those who are unable to perform their usual work for more than 15 consecutive days. Article 42 reserves retirement for permanent incapacity for those who are found to be incapacitated and unable to be rehabilitated for any activity that would provide their livelihood. Both require the waiting period, where applicable.
How do you apply for the right benefit: disability retirement or the sickness benefit?
Choosing the wrong benefit when you apply delays the process and reduces the amount you receive. It is important to consult a specialized lawyer to evaluate the particulars of the case and protect the insured worker’s social security rights.
