Evicção (eviction by superior title) is the total or partial loss of an acquired asset when a court decision or an act of a public authority recognizes that it belonged to someone else. The buyer has the right to be reimbursed by the seller, including the price paid and other expenses. The rule exists to protect good-faith buyers who believed they were buying from the person who actually had the right to sell. Within limits, the parties may adjust this warranty in the contract.
