Self-employed contributors, voluntary insured persons, and Individual Microentrepreneurs who have let months of social security contributions go unpaid have a legal way to regularize their situation. The process requires careful attention to how the charges are calculated, to the expiration deadline, and to the effect on the minimum contribution period (carência) required for benefits.
Who can pay contributions late
Brazilian social security law allows certain categories of insured persons to pay contributions after the due date. The main groups eligible for this type of regularization are self-employed contributors (contribuintes individuais), who work on their own account, and voluntary insured persons (segurados facultativos), who join Brazil’s General Social Security Regime (RGPS) without a mandatory employment relationship. Workers with a formal employment contract are in a different position: the employer withholds their contributions and pays them directly, so the responsibility for payment lies elsewhere.
The Individual Microentrepreneur (MEI) is a category of its own. Created by Complementary Law 123 of 2006, MEIs can regularize overdue months through payment slips issued on the SIMEI portal (the MEI simplified tax system), which apply their own rates and charges. Even so, regularization for the MEI does not remove the need to watch the expiration deadline, which can prevent certain months from counting toward the minimum contribution period.
The special insured person (segurado especial), who contributes based on the sale of rural production, falls under a different regime. Before trying to regularize overdue months, this contributor must follow the specific instructions of the rural funding rules. Mixing up insured categories when issuing the payment slip is a common mistake and can lead INSS (Brazil’s National Social Security Institute) to reject the period.
How to calculate and issue the payment slip with charges
A late payment cannot be made for the original amount of the contribution. Late-payment charges under Article 35 of Law 8.212 of 1991 are added to the amount owed: a late-payment penalty plus interest calculated at the accumulated SELIC rate (Brazil’s benchmark interest rate). The amount must be calculated month by month, because each month has its own due date and its own period of delay.
INSS provides a calculation and payment-slip tool on the Meu INSS portal (INSS’s online portal and app). The insured person opens the option for individual payment, selects the month to be paid, and the system automatically calculates the charges owed. The Guia da Previdência Social (the Social Security payment slip) must be paid by the due date shown. After that date, new charges accrue, and an updated slip must be issued before payment.
Each overdue month generates its own charges: the calculation must be done month by month to avoid underpayment and the risk that Social Security will reject the period.
There is no single, general administrative installment plan for overdue self-employed and voluntary contributions. The exception is specific programs that the federal government issues from time to time, each with its own conditions and deadlines. When no program is in effect, regularization is done through individual payment slips, issued separately for each month.
How regularization affects the minimum contribution period and benefits
Article 24 of Law 8.213 of 1991 defines the carência as the minimum number of monthly contributions an insured person must have made to be entitled to a benefit. Only contributions that have actually been paid count toward it. When a late payment is made correctly, INSS recognizes it and adds it to the contribution history in the National Social Security Information Registry (CNIS).
The law does, however, set an important time limit. Contributions paid more than five years late may be barred by the expiration period (decadência), which prevents them from counting toward the minimum contribution period and toward contribution time. This period comes from the National Tax Code, applies to social contributions, and runs from the date of the taxable event for each month. Checking whether a month can still be counted before issuing slips for very old months is therefore an essential step.
Another important point concerns insured status. In some cases, a late payment can affect whether you keep or regain your connection to the RGPS, especially when there are long gaps between contributions. Before deciding to regularize, you should review the grace period and the rules for maintaining insured status. Skipping this review can create an expectation of a benefit that your contribution history, even after regularization, cannot support.
Frequently Asked Questions
Can I pay INSS contributions for any past month?
There is no fixed deadline for an insured person to regularize overdue months, but the five-year expiration period can limit the effect of the payment. INSS may not recognize contributions whose taxable event occurred more than five years ago for purposes of the minimum contribution period and contribution time, even if you pay them with all the legal charges owed. For that reason, the sooner you regularize, the lower the risk of permanently losing the contribution period.
Does paying late guarantee that the month will immediately appear in the CNIS?
The CNIS is updated after an accredited bank processes the payment. In general, the entry appears within ninety days after the payment slip clears, though this can vary with INSS’s processing volume. If the month does not appear on your statement after that time, you can request its inclusion by filing a contribution regularization request on Meu INSS, attaching proof of payment of the Social Security payment slip.
What are the most common mistakes when paying contributions late?
The most frequent mistakes are: paying the original contribution amount without adding the penalty and interest, which leads to rejection of the period; issuing the slip with a payment code that does not match the insured person’s category; and paying months already barred by the expiration period without first checking whether they will be recognized. Generating the slip directly on the Meu INSS portal reduces these risks, because the system automatically calculates the charges and fills in the payment code that matches the category the insured person selects.
