MEI and Social Security: Contributions, Benefits, and How to Secure Your Retirement

The MEI (Brazil’s individual microentrepreneur regime) pays R$ 81,05 per month to INSS (Brazil’s National Social Security Institute) and has access to retirement by age, sickness benefit, and survivor’s pension, all capped at one minimum wage. For larger benefits, you need to pay a supplemental contribution.

For larger benefits, you need to pay a supplemental contribution.

The MEI pays R$ 81,05 per month to INSS and is entitled to retirement by age, sickness benefit, survivor’s pension, and maternity pay. But that amount covers only the basics. Your retirement benefit will always be 1 minimum wage, and your contribution time does not count toward the transition rules. If you want more, you have to pay a supplemental contribution, and that costs an additional R$ 243,15 per month.

How Does the MEI Contribution Work?

The MEI pays everything in a single payment slip: the DAS (Simples Nacional Tax Collection Document). The INSS portion built into it is 5% of the minimum wage (R$ 1.621,00 in 2026 = R$ 81,05).

The total DAS varies by type of activity:

  • Commerce or Industry: R$ 82,05 (INSS R$ 81,05 + ICMS R$ 1,00)
  • Services: R$ 86,05 (INSS R$ 81,05 + ISS R$ 5,00)
  • Commerce and Services: R$ 87,05 (INSS R$ 81,05 + ICMS R$ 1,00 + ISS R$ 5,00)

The due date is the 20th of each month. Late payment results in a fine and interest. Prolonged delinquency can lead the Receita Federal (Brazil’s Federal Revenue Service) to remove you from MEI status.

The legal basis is art. 21, §2º of Law 8.212/91, read together with Complementary Law 123/2006.

When Is It Worth Paying the Supplement?

The 15% supplement (GPS code 1910) turns the 5% contribution into 20% of the minimum wage. In 2026, that means paying an additional R$ 243,15 per month, for a total Social Security contribution of R$ 324,20.

With the supplement, you gain:

  • Valid contribution time for the transition rules of Constitutional Amendment 103/2019
  • The possibility of retiring on more than 1 minimum wage (if you contribute on a higher amount)
  • Reciprocal counting with public-servant pension systems (RPPS)

When does the supplement make sense?

You are close to meeting a transition rule. If you already have 25 years of contributions from previous jobs and need 10 more years as an MEI to reach 35, the supplement validates those 10 years.

You want a retirement benefit above the minimum. For that, paying the supplement is not enough; you must contribute on an amount higher than the minimum wage. In that case, it may make sense to switch to individual contributor status, paying 20% on your actual earnings.

You have old MEI contributions with no supplement. Retroactive supplementation is allowed (art. 21, §3º of Law 8.212/91), but it includes interest and inflation adjustment. Run the numbers first.

When does it not make sense?

If your goal is only retirement by age at 1 minimum wage, the 5% already secures it. Paying R$ 243,15 more every month for decades may not be worthwhile if the final benefit is the same. The calculation has to be done case by case.

MEI with a Formal Job: What Happens?

If you are an MEI and also hold a formal job with a signed work card, you keep both registrations at the same time. Your employer withholds INSS from your paycheck, and you continue paying the MEI’s DAS.

Get a fuller explanation in the firm’s guide: Supplemental Social Security Contributions 2026: When and How to Pay.

To calculate benefits, the contribution salaries from both sources are added together, up to the ceiling of R$ 8.475,55 (art. 32 of Law 8.213/91). If the total exceeds the ceiling, the excess contribution may be refunded through your income tax return.

In this situation, you generally do not need to pay the supplement on the MEI contribution, because the CLT (Brazil’s labor code) job already provides valid contribution time and amounts above the minimum.

Special MEI Categories and Changes in Classification

Some professional activities fall under the Individual Microentrepreneur regime with specific contribution rules. The Trucker MEI, created by Complementary Law 188 of 2021, pays INSS a rate of 12 percent of the minimum wage, higher than the 5 percent that applies to the traditional MEI. In return, the self-employed trucker becomes entitled to benefits calculated on a more favorable base, while the retirement-by-age benefit is still capped at one minimum wage when no additional supplement is paid on higher amounts.

A change in classification also deserves attention. When the MEI exceeds the annual revenue limit, currently set at 81 thousand reais, or hires more than one employee, the MEI is automatically disqualified and moved into the Simples Nacional as a Microenterprise. In this transition, Social Security contributions are no longer paid through the unified DAS and instead follow the general rules for companies, with employer contributions and payroll withholding. Earlier contributions made as an MEI remain valid, but the way your benefit is calculated is affected by the new regime.

If you want a retirement benefit higher than the minimum wage, in addition to the 15 percent supplement you can switch to individual contributor status, paying 20 percent on the earnings you actually receive, up to the INSS ceiling. This strategy is especially useful for self-employed professionals with high income who want to maximize their future retirement benefit, even at the cost of a substantially higher monthly contribution. The cost-benefit analysis must take into account how much contribution time you have left, your current age, and your projected retirement scenario.
