Permanent disability retirement protects workers who are permanently unable to perform any activity that would support them. It requires a medical examination, insured status and, in specific situations, a 25% increase in the benefit.
Permanent disability retirement (aposentadoria por incapacidade permanente) is the current name of the benefit that Brazilian law used to call disability retirement (aposentadoria por invalidez). The change in terminology followed Constitutional Amendment 103 of 2019, but the legal basis of the benefit remains in articles 42 to 47 of Law 8.213 of 1991. The purpose is the same: to support those who have lost, for the long term, the ability to work.
This benefit is not granted simply because you are ill. Approval depends on a technical evaluation that finds total incapacity and no possibility of rehabilitation for another occupation. Understanding these requirements helps you gather the right documentation and see why so many claims are denied at the administrative level.
What permanent disability retirement is
Under article 42 of Law 8.213 of 1991, permanent disability retirement is owed to an insured person who is found to be incapacitated and not susceptible to rehabilitation for any activity that would provide a livelihood. Payments continue for as long as that condition persists, which makes the benefit reviewable rather than definitive.
The evaluation looks at incapacity for work in general, not just for your usual occupation. If the medical examiner concludes that you can be retrained for another role compatible with your limitations, the path is not retirement but vocational rehabilitation or, where appropriate, the temporary disability benefit.
There is also an important rule about conditions that existed before you joined the system. An insured person who already had the disease or injury when entering Brazil’s General Social Security Regime is not entitled to the benefit, unless the incapacity results from the progression or worsening of that same condition. This distinction is often decisive when claims are reviewed.
Requirements to be entitled to the benefit
The first requirement is insured status at the moment the incapacity arises. This means you are either currently contributing or still within the so-called grace period, which preserves social security coverage for a time even after contributions stop. Without insured status, as a general rule, there is no right to the benefit.
The second requirement is the minimum contribution period (carência), meaning the minimum number of monthly contributions. Article 25 of Law 8.213 of 1991 requires twelve contributions for disability benefits. This requirement is not uniform, however: article 26 waives it in important situations, which tend to benefit those who most need immediate protection.
The twelve-contribution requirement is waived in cases of accidents of any kind and of occupational or work-related diseases, as well as serious illnesses listed in an official act of the competent ministries.
The third requirement is the incapacity itself, which must be total and permanent, with no reasonable prospect of recovery or retraining. That conclusion does not belong to the insured person or to a private physician. It is made by the federal medical examiner, based on the tests, reports and records you submit and on the clinical evaluation carried out on the scheduled day.
How the medical examination works
The medical examination is a mandatory step. Article 42 of Law 8.213 of 1991 makes approval conditional on verification of the incapacity through a medical examination conducted by Social Security. At your own expense, you may bring a physician you trust to the examination, which helps clarify technical aspects of your clinical condition.
Since Law 14.724 of 2023, the examination may be carried out by telemedicine or by document review, under the circumstances and requirements set out in regulations. Even so, the general rule remains an in-person evaluation, and the quality of the medical documents you submit weighs heavily on the outcome. Reports that are legible, dated and signed with the physician’s professional registration number reduce the risk of denial.
Even when you apply for a temporary disability benefit, the examiner may conclude that the incapacity is permanent. In that case, Social Security grants retirement instead of the temporary benefit, because the appropriate protection becomes the lasting one. Understanding the difference between temporary and permanent disability benefits helps you avoid mistaken expectations about the result.
How much the benefit pays and the 25% supplement
Under the General Regime, the ordinary calculation of permanent disability retirement after the reform starts at sixty percent of the average of your contributions. An increase of two percentage points per year applies to the time exceeding twenty years for men and fifteen years for women, according to article 26 of Constitutional Amendment 103/2019. The rule of one hundred percent of the average for incapacity resulting from a workplace accident, occupational disease or work-related disease must be distinguished from this ordinary calculation.
There is one significant exception. When the permanent incapacity results from a workplace accident, an occupational disease or a work-related disease, the same article 26 guarantees 100% of the average of contributions. The origin of the incapacity therefore directly changes the final amount and deserves attention when preparing the claim.
A 25% supplement may be added to this benefit. Article 45 of Law 8.213 of 1991 provides that the amount is increased by 25% when the retiree needs the permanent assistance of another person, a situation known as severe disability (grande invalidez). You must request this increase, which involves a new medical examination, and you can follow the progress through the digital services of Meu INSS (the online platform of Brazil’s National Social Security Institute, INSS). The supplement is owed even if the retirement benefit reaches the General Regime’s maximum ceiling, is recalculated with each adjustment and also applies to the 13th-month payment.
This supplement has clear limits. It ends with the retiree’s death and is not incorporated into the amount of the survivor’s pension. In addition, Brazil’s Supreme Federal Court, in Topic 1095 of general repercussion, decided that the increase is restricted to permanent disability retirement and cannot be extended by the courts to other types of retirement, because only legislation can create or expand social security advantages under the General Regime. The same decision preserved situations already recognized by a final judgment up to the date of that ruling.
Review, discharge, and termination of the benefit
Because the benefit is paid for as long as the incapacity lasts, permanent disability retirement can be reviewed. Article 101 of Law 8.213 of 1991 requires the insured person to undergo periodic medical examinations by Social Security, on pain of suspension of payment. This reassessment checks whether the conditions that justified the retirement are still present, and the deadline for reviewing INSS benefits itself has limits set by legislation and case law.
The law provides situations in which this reassessment is waived. Law 15.157 of 2025 updated the subject and eliminated the reexamination when the examiner finds that the incapacity is permanent, irreversible or unrecoverable, unless there is a well-founded suspicion of fraud or error. Insured persons with certain serious illnesses are also exempt, as are those who meet the age and benefit-duration criteria set by the legislation.
When the ability to work is recovered, the law provides for a gradual wind-down. Article 46 requires automatic cancellation of the retirement if the insured person voluntarily returns to work. Article 47 governs recovery established at an examination, providing for the benefit to continue for decreasing periods, with successive reductions, until it ends definitively, so as to avoid an abrupt loss of income.
Recognition of the right always depends on the analysis of the specific case, the medical documentation and how the facts fit the rules in force. Because the benefit involves technical requirements and its own deadlines, professional guidance at the administrative stage and, if necessary, in court tends to give the insured person greater security.
Frequently Asked Questions
What is the difference between permanent disability retirement and the temporary disability benefit?
Permanent disability retirement presupposes total incapacity with no prospect of rehabilitation, and payments continue for as long as that condition persists. The temporary disability benefit covers situations in which recovery or retraining is expected within a certain period. The federal medical examiner decides which one applies, based on your clinical condition.
Does the 25% supplement apply to every type of retirement?
No. The 25% supplement in article 45 of Law 8.213 of 1991 was provided only for permanent disability retirement, when the insured person needs the permanent assistance of another person. In Topic 1095, Brazil’s Supreme Federal Court barred the automatic extension of the increase to other types of retirement, finding that only legislation can expand this benefit.
Can permanent disability retirement be canceled?
Yes. The benefit can be reviewed at a periodic medical examination and ends when the ability to work is recovered, as provided in articles 46 and 47 of Law 8.213 of 1991. The legislation, however, waives reassessment in specific cases, such as when the incapacity is recognized as irreversible, which reduces uncertainty in the most serious cases.
