The INSS (Brazil’s National Social Security Institute) cap table tracks how maximum benefit amounts have changed over more than three decades. It is an indispensable reference for review calculations and retirement planning.

What the Social Security Cap Is and Why It Matters

The social security cap is the maximum amount a beneficiary of the RGPS (Brazil’s General Social Security Regime) can receive each month. This limit applies to retirement pensions and to all other INSS benefits, such as temporary disability benefits, survivor’s pensions, and accident benefits (auxílio-acidente).

The social security cap in 2026 is R$ 8.475,55, the amount that sets the maximum limit for both contributions and benefits under the General Social Security Regime.

Understanding how this cap has changed over time is useful if you need to check the calculation of a benefit that has already been granted, and also if you are still in your contribution years. The table can help you spot errors involving the cap, wages, or contribution periods. However, the so-called “whole-life review” (revisão da vida toda) was overturned as a general thesis by the STF (Brazil’s Supreme Federal Court) and should not be treated as an open path to recalculation.

The federal government adjusts the cap every year, usually at the start of the year, following the minimum wage appreciation policy and the inflation adjustment indexes that apply to the RGPS. Since 1994, with the economic stabilization that followed the Real Plan, the amounts have become more predictable and the adjustments more transparent.

Historical Table of INSS Caps: 1994 to 2026

Below is the series of social security caps since Brazil’s monetary stabilization. The amounts follow the historical series of the maximum contribution wage limit and the highest benefit-calculation ceiling published in the Historical Supplement to the Statistical Yearbook of Social Security, prepared by the Statistics Coordination Office of the Ministry of Social Security. They are supplemented by the 2024 and 2025 interministerial ordinances and by the adjustment in effect in 2026:

How the Cap Affects Benefit Calculations

The cap affects the amount of your benefit in two distinct ways. The first involves the contribution wage (salário de contribuição): a worker who earns more than the cap pays contributions on the maximum limit, not on the full salary. So even if you earn R$ 15.000,00 a month, you contribute as though you earned R$ 8.475,55, and you will also receive no more than that amount as an RGPS benefit.

The second way the cap matters is in the benefit calculation itself. The average of your contribution wages, which is the basis for your retirement benefit, is limited to the amounts that were actually treated as the cap in each month. As a result, historical wages above the cap in force at the time are counted at the cap for the corresponding period.

This can matter in administrative and judicial reviews that dispute an error involving the cap, a wage, or a period that should have been counted. Including wages earned before July 1994 through the so-called whole-life review was rejected as a general ground by the STF. Any earlier situation must be checked against the case file, the decision, and the applicable modulation of effects.

INSS Cap Versus RPPS Cap

People often confuse the RGPS (INSS) cap with the constitutional cap on the pay of the justices of the Supreme Federal Court, which serves as the maximum limit on compensation in the public service. The social security cap for federal civil servants under the RPPS (Brazil’s Own Social Security Regime for public servants) follows its own rules and may exceed the INSS limit.

For ordinary workers enrolled in the RGPS, however, the cap set each year by the Ministry of Social Security is the absolute limit, both for contributions and for benefits. There are no exceptions within the general regime.

If you want to understand how contribution periods are recorded and how to fix inconsistencies in your social security history, we recommend reading the article on how to correct the CNIS when it contains wrong employment records.

Why It Matters for Benefit Reviews

The historical cap table is an essential tool for social security lawyers and for insured persons who want to check whether a benefit was calculated correctly. In many administrative and judicial cases, it turns out that the INSS applied the wrong cap to a given month, resulting in a payment lower than what was owed.

In a benefit review, you need to rebuild the insured person’s contribution history month by month, comparing the contribution wages actually recorded in the CNIS (Brazil’s National Registry of Social Information) with the caps for each period. Any discrepancy can mean significant differences in the benefit amount and in the back payments owed.

Frequently Asked Questions

What is the INSS cap in 2026?

In 2026, the RGPS social security cap is R$ 8.475,55 per month. This amount is the maximum limit for both the contribution wage and the benefit that an insured person can receive under the General Social Security Regime. The adjustment in effect from February 2026 followed the index applied to the minimum wage and the correction set by the federal government.

Why does the social security cap go up every year?

The annual adjustment of the social security cap stems from a legal provision and aims to preserve the purchasing power of benefits over time. The federal government sets the adjustment index and publishes it by ministerial ordinance, usually at the start of each year. Besides inflation, factors such as increases in the minimum wage influence the adjustment applied to the RGPS cap.

How is the historical INSS cap used in benefit reviews?

In administrative or judicial reviews, the historical cap is used to check whether the contribution wages for each month were correctly limited. When the INSS applies a cap different from the one in force in that month, the calculation of the average can be harmed. The historical table makes it possible to identify these inconsistencies and to support requests to review a benefit that has already been granted.
