Habeas corpus is the constitutional guarantee that protects freedom of movement against illegality or abuse of power. It is available in classic situations ranging from unlawful restraint to imminent coercion, including detention without sound legal grounds and unreasonable delay in the criminal proceedings.

What habeas corpus is and when it applies

Habeas corpus is a constitutional remedy designed to protect freedom of movement. It is provided for in Article 5º, item LXVIII, of the Federal Constitution and regulated by Articles 647 to 667 of the Code of Criminal Procedure. It applies whenever someone suffers, or is under threat of suffering, violence or coercion against their freedom to come, go, and stay, because of illegality or abuse of power.

The writ comes in two forms. Release habeas corpus (liberatório) is for a person who is already being unlawfully restrained, and it seeks to end the restriction in progress. Preventive habeas corpus, known as a safe-conduct order (salvo-conduto), is for a person facing a concrete and imminent threat of restraint, and it provides protection before the harm occurs.

Under Article 654 of the Code of Criminal Procedure, anyone may file the petition on their own behalf or on behalf of another person, even without a lawyer. Because the remedy is informal, free of charge, and follows a summary procedure, habeas corpus is the fastest procedural route for challenging improper restrictions on liberty.

Classic situations in which it is available

Article 648 of the Code of Criminal Procedure lists the situations that amount to unlawful coercion, and these form the historical core of the cases in which habeas corpus is available. The first is the lack of just cause, meaning arrests, investigations, and criminal prosecutions that lack even minimal evidence of authorship and of the fact of the crime. Case law has established that when the conduct clearly does not constitute a crime, the prosecution may be halted through the narrow channel of the writ.

The second situation is unreasonable delay in building the case against the defendant, especially when the defendant is held in pretrial detention. The Superior Court of Justice (STJ) maintains that unjustified delay in the evidentiary phase of a criminal case, when the defense is not to blame, is unlawful restraint that habeas corpus can remedy. This is so even though the court’s own Súmula 52 (its published summary of settled case law) rules out that argument once the evidentiary phase has closed.

The writ is also available when the authority ordering the restraint lacks jurisdiction, when the statute of limitations or another ground has extinguished criminal liability, when the proceeding is void, or when someone is held longer than the law allows. Each of these situations involves an objective illegality that can be seen at first glance, without the need for an in-depth review of the evidence.

Habeas corpus is informal so that liberty never depends on procedural technicalities.

Case law has expanded this list. It now allows the writ against decisions that order pretrial detention without concrete reasons, in violation of Article 312 of the Code of Criminal Procedure and Article 93, item IX, of the Constitution. Brazil’s Supreme Federal Court (STF) has consistently rejected generic formulas based solely on the abstract seriousness of the crime or on public outcry.

It applies whenever someone suffers, or is under threat of suffering, violence or coercion against their freedom to come, go, and stay, because of illegality or abuse of power.

Practical aspects of filing the petition

The petition must identify the authority responsible for the restraint, the person in whose favor the writ is sought (the paciente), the petitioner, and the facts showing the coercion. A power of attorney with specific powers is not required, because the remedy is not reserved for lawyers. Jurisdiction follows the rank of the authority named as responsible for the restraint, under Article 650 of the Code of Criminal Procedure and the rules of judicial organization.

A request for a preliminary injunction is allowed whenever both the fumus boni iuris (a plausible legal claim) and the periculum in mora (risk of harm from delay) are present, and it is very useful for immediately suspending the effects of the challenged order. If the injunction is granted, the reporting judge requests information from the authority responsible for the restraint and, after the Public Prosecutor’s Office weighs in, brings the case to a panel of judges for decision.

Súmula 691 of the Supreme Federal Court restricts the use of habeas corpus against single-judge decisions that deny a preliminary injunction in another habeas corpus case. Even so, the Court itself allows exceptions in cases of flagrant illegality, gross aberration, or abuse of power. This flexibility preserves the writ’s role as the ultimate protection against clearly unlawful restrictive acts.

Frequently Asked Questions

Who can file habeas corpus?

Anyone, whether Brazilian or foreign, can file habeas corpus on their own behalf or on behalf of another person, regardless of whether they are authorized to act in court as a lawyer. Article 654 of the Code of Criminal Procedure does not require representation by a lawyer. Even so, professional help significantly improves the chances of success, especially in the legal reasoning and in dealing with sophisticated procedural arguments.

What is the difference between release and preventive habeas corpus?

Release habeas corpus is for a person who is already suffering actual restraint of liberty, and it seeks to end the restriction immediately, as in unlawful arrests or cases without just cause. Preventive habeas corpus, also called a safe-conduct order, is for a person facing a concrete and imminent threat of restraint. It provides protection before the violence occurs and works as a true injunctive protection of freedom of movement.

Can habeas corpus be used to challenge the evidence?

As a general rule, the narrow channel of the writ does not allow an in-depth review of all the evidence, precisely because the procedure is fast and based on documents. However, the court may analyze the evidence when the illegality is apparent at first glance and no further fact-finding is needed. Examples include conduct that clearly is not a crime, a complete absence of evidence of authorship, or arrests based on evidence obtained by plainly unlawful means.
