BPC/LOAS for Older Adults and People with Disabilities: Eligibility Criteria and How to Apply

The Benefício de Prestação Continuada (Continuous Cash Benefit), known by its acronym BPC, guarantees one monthly minimum wage to people aged 65 or older and to people with disabilities of any age who can show they have limited financial means. You do not need to have paid into INSS (Brazil’s National Social Security Institute) beforehand to qualify. The benefit is governed by the Organic Law on Social Assistance (LOAS), Law 8.742 of 1993.

What the BPC is and who is entitled to it

The BPC is a social assistance benefit, not a social security benefit. That means you do not need any history of contributions to the general social security system. It is funded entirely from the social security budget, which the federal government manages through the Ministry of Social Development and Assistance.

For older adults, the law sets a minimum age of 65 completed years. For people with disabilities, the law requires proof of a long-term impairment, whether physical, mental, intellectual, or sensory, that, in interaction with barriers, may hinder full and effective participation in society on an equal basis with others. The impairment must last at least two years, as provided in Article 20, paragraph 2, of Law 8.742 of 1993.

To assess a disability for purposes of the BPC, a medical expert and a social worker from INSS evaluate the applicant together. They use specific assessment tools that take into account both the medical and the social side of the applicant’s situation.

The income test: showing limited family means

In addition to the specific requirements of age or disability, both older adults and people with disabilities must show that per capita family income is below one quarter of the current national minimum wage. For this calculation, the family group includes the applicant, spouse or partner, parents, and unmarried siblings and children who are under 21 or have a disability and who live under the same roof.

The minimum wage is divided by the number of people in the family group, and the resulting average must fall below the legal limit. Social security and social assistance benefits received by members of the family group count as income, except in cases the law expressly exempts, such as another BPC already granted to a member of the same family.

Per capita family income below one quarter of the minimum wage is a necessary condition, but not a sufficient one: the benefit review takes into account the applicant’s overall socioeconomic circumstances.

Brazil’s Supreme Federal Court has ruled, in a case of repercussão geral (general repercussion, a precedent-setting procedure), that the one-quarter minimum wage threshold is an objective benchmark, but not an absolute one. In practice, INSS and the courts may consider other factors that show a situation of extreme poverty, especially when per capita income exceeds the legal limit only slightly.

How to apply for the BPC: step by step

You can file a BPC application through INSS’s official channels, with no need for intermediaries. The main way to apply is the Meu INSS app, which is available for mobile devices and can also be accessed through the website meu.inss.gov.br. In-person service at INSS offices is an alternative for applicants who have difficulty with digital access.

To support your application, you will need documents proving your identity and your Individual Taxpayer Registry (CPF) number, documents for each member of the family group showing their income, proof of residence and, for people with disabilities, medical reports that describe the diagnosis, the treatments received, and the functional limitations. After you file the application, INSS schedules the medical examination and the social assessment.

The legal deadline for INSS to review and decide is 45 days from filing. If the application is denied, you may file an administrative appeal with the Social Security Board of Appeals within 30 days of receiving the denial letter. Once the administrative route is exhausted, you can seek judicial relief, including a request for preliminary relief when the legal requirements are met.

Frequently Asked Questions

Can you receive a retirement benefit and the BPC at the same time?

No. The law expressly prohibits receiving the BPC together with any social security benefit, whether under the general system or under the special public-sector systems, except for the special compensatory pension. If you choose the BPC, you must request that your social security benefit be terminated, or the other way around, depending on which is more advantageous in your particular situation.

Can the BPC be canceled after it is granted?

Yes. INSS conducts periodic reviews to verify that the conditions that justified the benefit still exist. If it is shown that per capita family income has exceeded the legal limit, that an older adult beneficiary has died, or that a beneficiary with a disability has regained the ability to work, the benefit is terminated. Beneficiaries have a duty to report to INSS any change in their financial or health situation.

Can a minor with a disability receive the BPC?

Yes. There is no minimum age for receiving the BPC for people with disabilities. Children and teenagers with a long-term impairment who meet the family income test are entitled to the benefit, and the application must be filed by their legal representative. When calculating per capita income, the amount of any other BPCs received by family members is not counted.
